General terms and conditions for the use of Encipher.Me

§1 Scope and Contracting Party

(1) These terms of use apply to the use of the web service Encipher.Me, a zero-knowledge encryption service for temporary messages.

(3) By using our service, you acknowledge these terms of use as binding.

§2 Service Description

(1) Encipher.Me offers a free web service for encrypted transmission of temporary messages with zero-knowledge architecture.

(2) The service allows users to encrypt text messages client-side and securely share them via a generated link.

(3) Messages are automatically deleted after a configurable access limit (1-20 retrievals) or after 30 days at the latest.

(4) Registration is optional - the service can also be used anonymously.

§3 Zero-Knowledge Principle and Privacy

(1) Encipher.Me implements true zero-knowledge architecture - we technically cannot decrypt your messages.

(2) All encryption keys are generated client-side and transmitted via URL fragments that never reach our servers.

(3) We only store encrypted data blocks without the possibility of decryption.

(4) For all users, IP addresses are stored during security violations (IP ban system). For registered users, additional session information is stored for account security - details in the privacy policy.

§4 User Obligations

(1) The user agrees not to use the service for illegal purposes.

(2) Particularly prohibited is the transmission of:

  • Illegal content (copyright violations, malware, etc.)
  • Hate speech, discrimination or insults
  • Spam or unwanted mass messages
  • Data that violates privacy regulations

(3) Users are required to use secure passwords and keep their credentials secret.

(4) Abuse of the service for automated requests or DoS attacks is prohibited.

§5 Availability and Disclaimer

(1) We strive for high availability of the service but do not guarantee uninterrupted operation.

(2) Use is at your own risk. Subject to the provision in paragraph 3, we are in particular not liable for:

  • Data loss or premature deletion of messages
  • Damage from misuse of the service by third parties
  • Technical disruptions or failures
  • Incompatibilities with user systems

(3) We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health and under the German Product Liability Act. As the service is provided free of charge, our liability is otherwise limited to intent and gross negligence (Section 521 German Civil Code, BGB).

§6 Registration and Account Management

(1) Registration is voluntary and free.

(2) Registered users can manage their sent messages and view statistics.

(3) Users can delete their account at any time - all associated data will be permanently removed.

§7 Termination and Blocking

(1) Use can be terminated by either party at any time without giving reasons.

(2) In case of violation of these terms of use, we reserve the right to block user accounts.

(3) When an account is blocked, all associated data will be deleted.

§8 Changes to Terms of Service

(1) These terms of use may be changed as needed.

(2) Changes will be announced on the website and take effect 14 days after publication.

(3) If the user does not object to the changes within 14 days, they are considered accepted.

§9 Final Provisions

(1) German law applies excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the state of their habitual residence.

(2) If the user is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Berlin, Germany. For consumers, the statutory places of jurisdiction apply.

(3) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
